These terms and conditions (the “Terms and Conditions”) are the terms and conditions upon which www.GiftsInIsrael.com, a website of EstiB Ltd. (“we/us/our”) make this website (the “www.GiftsInIsrael.com”) available to you and any of our services which are accessible on or via the www.GiftsInIsrael.com site (the “www.GiftsInIsrael.com Services”).
1.1 All products as depicted on this website (as may be varied from time to time) are available in every city of the respective country under which the product is displayed. Certain product ranges are available in selected delivery areas only and such information is given in the respective product pages.
1.2 All products are subject to availability. In the event of any supply difficulties, we reserve the right to substitute with a product of equivalent value and quality, if the same is unavailable after order confirmation notification.
1.3 If we are unable to offer wine or any other add-ons (Finishing Touch items) with products ordered from selected ranges, the same information would be communicated to you either during or after placing your order.
1.4 Most our products may not be available for same day delivery or other special delivery services. Such information is given in the respective product pages
Although a very rare case, please note in some locations we may need an additional 24 hours for the delivery of gifts, wines, gift baskets etc. We deliver only the finest quality of gifts (branded items, wherever applicable).
2.1 GiftsInIsrael.com does not sell alcohol to persons under the age of 18. By using GiftsInIsrael.com site you swear and affirm that you are over the age of 18. GiftsInIsrael.com makes every effort to ensure that alcoholic beverages are not delivered to anyone who is under the age of 18. By using this site you are acknowledging that the person receiving a shipment of alcoholic beverages from GiftsInIsrael.com is over the age of 18. You also agree that any alcohol purchased from GiftsInIsrael.com is intended for personal consumption and not for resale. If you do not agree with these conditions of use please do not use this site. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 18. GiftsInIsrael.com will prosecute you fully to the extent allowable by law.
2.2 Wines are available for delivery subject to government restrictions in the respective country/state/locality. We mention the restrictions in the shipping policy in the respective product pages.
2.3 Our services are provided to adults over the age of eighteen (18) years. By proceeding to purchase through our website, you acknowledge that you are over 18 years of age.
2.4 We strongly suggest shipping your order to a business address whenever possible. an adult signature will be required (at least 18 years of age) at the time of delivery for every package. It is your responsibility to ensure an adult is available to sign for the shipment at delivery.
Shipments will not be delivered under the following circumstances:
3.1 Prices listed within the GiftsInIsrael.com Service are valid for a maximum of 14 days of submitting your order.
3.2 All prices are in Shekels (ILS) and are inclusive VAT. We endeavor to ensure that our price list is current. Our price list can be accessed from our home page and we reserve the right to amend our prices at any time. If you have placed an order, we undertake to fulfill your order at the price listed at the time you ordered.
3.3 Prices include VAT for products, services & deliveries.
4.1 While to check out (place the order), you will be required to provide us with a few personal details, including the phone number and/or email id, along with those of the intended recipient and all necessary payment details.
4.2 We accept payment by Paypal and all major credit cards Visa, Master.
4.3 By clicking on the ‘place order’ button at the end of the order process, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions appearing anywhere on the GiftsInIsrael.com site.
4.4 Submitting your order is subject to our acceptance of this offer. We will send an email confirmation of your order details to advise that we are processing your order via the email address you provide. We will not consider ourselves bound by a contract with you until we have issued this email confirmation.
5.1 Selected products may not be available for delivery to certain localities. We try our best to provide with such information either on the respective product page, during checkout or will communicate you after you place your order.
5.2 We do not recommend courier deliveries to hospitals or army bases or funerals.
5.3 Shipping Methods – If you wish a delivery to be made within a specific time period, you can choose the respective shipping method shown on the respective product page. Please note that some shipping methods are subject to availability and that at certain times of the year the charges for the service may vary. The information and the available shipping methods are always provided on the respective product pages when you place your order.
5.4 Deliveries via courier services cannot be delivered at specific times. All orders will be delivered during the working day between 10 am to 7 pm (in the recipient time zone) during normal working days, Sunday to Thursday (exceptions are such high gifting days like Valentine’s Day, Mother’s Day, etc. during which deliveries can happen beyond this time range).
5.5 Deliveries are available only on the days mentioned (that can be selected). If you could not choose a delivery date of your choice, it means a delivery is not possible on that day. Please contact our customer service team if you need any suggestions on any other gifts that may be available for your chosen day.
5.6 To avoid problems or delays with delivery, please ensure that you have provided with the full address details, including accurate postcode of the recipient and telephone number so that it would be easy for our delivery services to locate them. It would also be very helpful if you provide us with your daytime contact telephone number or e-mail address so that we can notify you in the event that any delivery problems are encountered.
5.7 Certain products cannot be delivered on a specific delivery date but will be delivered during a delivery period (for eg., delivery in 2-4 business days or 3-7 business days, etc.). The time it takes for such products to be delivered is shown on the respective product page near the shipping method area. Please contact our customer service for any questions you may have about delivery dates for such products.
5.8 Whilst we agree to use all reasonable endeavors to ensure that delivery will be on the requested delivery date or during the delivery period, you acknowledge that actual delivery will be via a local florist (or local gift shop, as applicable) or for certain orders via third party courier service. In very occasional circumstances delivery on the requested terms will not be possible, in such circumstances you will be given prior notice wherever possible.
5.9 In the case of delivery to certain locations, where a third party is involved, such as offices, hospitals, Funeral Directors, airports, hotels, ships and other business locations, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery to your chosen recipient.
5.10 Please be aware that the carrier will deliver the goods to the address provided in good faith and we cannot accept responsibility if the intended recipient is no longer at that address and the receiver refuses or fails to return the items.
5.11 Please note that where the carrier is unable to find someone to accept delivery, or unable to leave the delivery in a secure location, they will leave a card at the address for the recipient to make contact and re-arrange delivery. If the recipient fails to make contact in good time we reserve the right to charge for re-delivery to that or an alternative address.
5.12 Please note that if you order a number of items for delivery to the same address, they may be dispatched separately and we cannot guarantee delivery on the same day/time.
5.13 We shall not be liable for any failure to perform our obligations where such failure is as a result of Acts of God (including fire, flood, heavy weather, earthquake, storm, hurricane or another natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service.

Such requests for cancellation/amendment are processed subject to the request before cut-off time (the time before which the order is processed/prepared).
6.1 We regret that you may not cancel an order once your order is shipped/dispatched.
6.2 You are entitled to cancel any payment at any time where fraudulent use has been made of your credit or debit card by another person not acting on behalf of you or as your agent and to be re-credited by us to the extent that such sums are not reimbursed by the card issuer in such circumstances.
7.1 (a) We accept liability for death or personal injury arising from our negligence.
7.1 (b) Subject to clause 7.1(a), our liability in contract, tort (including negligence and breach of statutory duty) or otherwise arising by reason of or in connection with your order with us shall be limited to a multiple of  times the price you have paid for the products.
7.1 (c) Subject to clauses 7.1(a) and 7.1(b) above we exclude all liability for any claims, losses, demands and damages, including without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, arising directly or indirectly out of or in any way connected with your use or inability to access the GiftsInIsrael.com Site and/or the GiftsInIsrael.com Service, whether arising in contract, tort (including negligence), under statute or otherwise PROVIDED THAT nothing contained in these Terms and Conditions affects or will affect your or the recipient’s statutory rights in relation to the quality, fitness or description of the products supplied.
7.1 (d) Subject to clauses 1.5 above, we shall not be liable for any delay or inability to perform our obligations to you if such delay is due to any cause whatsoever beyond our reasonable control.
8.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the GiftsInIsrael.com site and/or the GiftsInIsrael.com Services from time to time. We will post any changes on the GiftsInIsrael.com site and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the GiftsInIsrael.com Services or GiftsInIsrael.com site. Changes will be effective five (5) hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.

10.1 To register with any of the GiftsInIsrael.com Services, you must be over eighteen years of age.
10.2 You are advised to change the automated password (as soon as possible from the time of you receiving it) that our GiftsInIsrael.com Service generates. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password.
